Guardians, who have the power to make health care decisions, may create a power of attorney for health care and designate another to make health care decisions for an adult child with special needs. While laws vary by state, in some states, the power of attorney for health care can take precedence over any guardianship orders in all health care decisions, unless a court orders otherwise. This may help if the guardian is deployed or has to travel, because health care emergencies can arise at any time.
